Putti Lal Sen v. State Of U.P. & Others - SPECIAL APPEAL No. 1661 of 2006 RD-AH 56 (2 January 2007)
Hon'ble S.Rafat Alam, J.
Hon'ble Sudhir Agarwal,J.
Heard learned counsel for the appellant and also perused the judgment of the Hon'ble Single Judge of this Court dated 20.11.2006 in Civil Misc. Writ Petition 63128 of 2006.
Learned counsel for the appellant could not point out any factual or legal error in the judgment/order of the Hon'ble Single Judge or in the order impugned in the writ petition. He, however, submitted that the petitioner-appellant made a representation for re-considering the order of transfer, which has also been rejected on 6.10.2006. It is not in dispute that the petitioner-appellant is posted at Meerut since last nine years and the order of transfer has been made on account of administrative exigencies. However, it is submitted that the petitioner-appellant may be allowed to continue for a period of three months further. We do not find any substance in the submission for the reason that the order of transfer has been passed in July, 2006 and the petitioner-appellant is continuing to remain at Meerut because of the interim order in the writ petition.
Thus, we do not find any reason to take a different view. The appeal being without merit, is hereby dismissed.
