HIGH COURT OF JUDICATURE OF ALLAHABAD

Criminal Misc. Writ Petition No. 4335 of 2007

Bhola Shanker Vs. State of U.P. & others

Hon'ble S.Rafat Alam, J.

Hon'ble Krishna Murari,J.

Heard learned counsel for the petitioners and also perused the impugned FIR.

The allegation made in the FIR  prima facie discloses commission of cognizable offence and, therefore, we are not inclined to quash the same or to stay the arrest of the petitioners.

The writ petition is, therefore, dismissed.   It is, however, provided that in the event the petitioner surrenders before the court concerned and moves application for being released on bail in case crime no. 77 of 2007, under Sections 467,468,471 and 420 I.P.C., Police Station Kotwali Hathras, District Hathras, the same may be considered and disposed of expeditiously.
