Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents and perused the record.
The petitioner is aggrieved by an order dated 3.10.2003 whereby it has been directed that the period during which he remained under suspension would not be treated towards service nor would the petitioner be paid salary for the said period. The petitioner is challenging the said order after more than three years. Even otherwise, the petitioner admits that he has an alternate remedy of filing an appeal against the impugned order which has not been availed by him.
In such view of the matter, on the ground of availability of alternate remedy as well as on the ground of approaching this Court after such a long period, I would not be inclined to interfere with the impugned order.
This writ petition is, accordingly, dismissed. No order as to cost.
