The appeal was filed on 9th February,1987 when it has been shown by the office of the Stamp Reporter that ad valorem court fees of Rs.13,827.50 is not paid. Ultimately on 5th July,1988 Sri R.C.Singh, learned counsel for the appellant, states that inspite of several reminders, the appellants have not responded. The deficiency not having been made good within the time allowed by this Court. The memorandum of appeal was rejected. Now, an application was made on 28th September, 2005 depositing of such court fees with an application for condonation of delay along with restoration application. We cannot entertain the same, since we do not find any reason or explanation, the appellant is not the vigilant litigant. Therefore, no encouragement should be given to such type of litigant. Hence, the application for condoning the delay along with restoration application and accepting the court fees both are rejected by this court.
No order is passed as to costs.
