Smt. Richa Rani & Another v. State Of U.P. & Others - WRIT - C No. 20685 of 2007 RD-AH 7697 (25 April 2007)
Hon'ble Dr. B.S. Chauhan, J.
Hon'ble Rajes Kumar, J
This is one of the most scandalous writ petition which can be filed in a Court of law,and for the purposes of the children who run away from home and got married either by force or by their free will. Every day we have experienced that large number of persons are produced before the Court that they have got married and they apprehend threat to their lives by the parents and family members. This writ petition has been filed contending that both the petitioners are Hindu. We fail to understand under what circumstances the marriage can be reduced merely on the basis of the agreement of contract and why the agreement of contract had been signed by the said petitioners. There is no proof of age and no attempt has been made to explain that what is her age or annexing any document to substantiate that the petitioner no.1 is major and filing of this kind of scrupulous writ petition has to be disapproved. We have no other option but to dismiss the writ petition.
Writ petition is, accordingly, dismissed.
