Heard learned counsel for the petitioner.

According to the first information report, the petitioner appeared in the intermediate Examination as a private candidate in the year 1988 with Roll No. 501119 on the strength of a forged transfer certificate No. 3197 purporting to be issued by K.V.E. College, Mahalwala, Meerut. According to the first information report, although the petitioner had failed in the High School Examination but the forged transfer certificate showed the petitioner as having passed the High School Examination.

The defence of the petitioner is that he had passed the High School Examination in 1985 from P.G. Intermediate College, Maskanwa, Gonda, as a private candidate with Roll No. 143351 and, thereafter did not study further and, never filled the form for Intermediate Examination as private candidate in 1988.

In view of these averments of the petitioner, we dispose of this writ petition directing the Investigating Officer not to arrest the petitioner in case crime No. 145 of 2006 under sections 420/467/468/471 I.P.C., P.S. Incholi district Meerut, unless he verifies from the original records that the petitioner had applied for Intermediate Examination, 1988, as alleged in the first information report with the details mentioned in the first information report and, also verifies the genuineness of the petitioner's claim of having passed the High School Examination, 1985 and, comes to the conclusion that the petitioner had not passed his High School Examination in 1985.
