Learned counsel for the petitioner, Sri Ajai Rajendra, has submitted that since respondents have already allowed the petitioner to function as teacher, therefore, first relief has become infructuous. In view of the above for rest of the reliefs also the writ petition has become infructuous. Therefore, the writ petition is accordingly dismissed as having become infructuous in view of the judgment reported in 1999 ALJ 185, Dr. Sudhakar Malviya and others v. Banaras Hindu University, Varanasi and others.
