Heard counsel for the petitioner and the learned standing counsel. No notice is being issued to the private respondents No. 4 and 5.
The only prayer pressed by the petitioner is that the direction be issued to the respondent no.2 to consider the claim of the petitioner in respect of his promotional post. Petitioner's case in the writ petition is that he was appointed as class IV employee on 27.11.1971 and since then he is working on Class IV post but he has not been given promotion to class III post. The petitioner has made representation to the Consolidation Commissioner on 16.11.2005 Annexure-6 to the writ petition. Ends of justice be served in disposing of the writ petition directing the respondent No. 2 the Consolidation Commissioner to consider and take appropriate decision on the representation of the petitioner dated 16.11.2005 for promotion to Class III post expeditiously preferably within a period of three months from the date of production of a certified copy of this order. It is made clear that this Court is not expressing any opinion on the merits of the case and it is for the respondent no. 2 to consider the claim of the petitioner according to seniority and eligibility as and when the promotion exercise is taken place for filling up Class III posts under the promotional quota.
With the above observations the writ petition is disposed of.
