Learned standing counsel appearing for the respondents prays for and is allowed four weeks' time to file counter affidavit. List thereafter.
Learned counsel for the petitioner contended that although by the order dated 16.4.2007 the respondents have invoked the power under Rule 8(2)(b) of the U.P. Police Officers of Subordinate Ranks (Punishment and Appeal) Rules, 1991, there is no reasons recorded as to why it is not practically reasonable to hold an enquiry. Learned counsel for the petitioner further submits that the identical writ petitions have been entertained and this Court has granted interim order to similarly situated recruits. Reference has been made to the writ petition No. 13429 of 2007 Ravi Nandan Vs. State of Uttar Pradesh & others. Following the interim order passed in the aforesaid writ petition it is provided that the impugned order dated 16.4.2007 shall remain stayed and the petitioner shall be permitted to continue and complete his training. However, no appointment shall be given without leave of this Court.
