Mahatab Singh v. Ram Sahai& Others - WRIT - B No. 1681 of 1974 RD-AH 8555 (7 May 2007)
Civil Misc. Writ Petition No. 1681 of 1974
Mahtab Singh through L.Rs.
Ram Sahai through L. Rs. And others
Hon'ble Krishna Murari, J.
Heard learned counsel for the petitioner.
This petition arises out of chak allotment proceedings. On an objection filed by contesting respondent no. 1 under Section 20 of the U. P. Consolidation of Holdings Act, minor adjustments were made by the Consolidation Officer vide order dated 6.2.1970. The said order was challenged by the petitioner by filing appeal on the ground that some area of plot no. 1441 has wrongly been left as land appurtenant to building which was dismissed. However, appeal filed by contesting respondent no. 1 was allowed by appellate authority and he was allotted chak on some area of plot no. 1441. Aggrieved by the same, petitioner went up in revision. Revisional court found that petitioner has already been allotted chak on some area of plot no. 1441 and both his chaks are on his original holdings and thus dismissed the revision. Aggrieved, the petitioner has approached this Court.
In view of the findings recorded by the Deputy Director of Consolidation which are in the nature of finding of fact that petitioner has been allotted chak on plot no. 1441 and both chaks have been allotted on his original holding, there is hardly any scope for interference by this Court.
Writ petition accordingly fails and is dismissed.
