Heard learned counsel for the appellants and the learned A.G.A. for the State and perused the lower court's record.

Learned counsel for the appellants submits that there are cross version and there is one deceased on the side of the appellants and the injuries sustained on the side of defence is not explained by the prosecution.

Considering the facts and circumstances of the case the appellants are admitted to bail.

Pending appeal, appellants namely, Dev Raj alias Devthan and Hakim Singh convicted in S.T. No. 234 of 2004 shall be released on bail on each of them executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.

Till further orders, realization of fine shall also remain stayed.
