Heard counsel for the petitioner and the learned standing counsel.
By this writ petition the petitioner has prayed for quashing the suspension order dated 3.5.2007. Learned counsel for the petitioner submits that the charge in the suspension order is no serious enough to merit major penalty and in accordance with rule 4 (1) proviso of U.P. Government Servant (Discipline and Appeal ) Rules, 1999 the petitioner was not liable to be suspended. He further submitted that in the enquiry which was conducted by the District Supply Officer the petitioner was not found involved and the allegations were made against the Gram Pradhan and Gram Vikas Adhikari.
Considering the above submission the petitioner has made out prima facie case for grant of interim relief. Learned standing counsel is allowed four weeks time to file counter affidavit. List thereafter for admission.
In the mean time the impugned order dated 3.5.2007 suspending the petitioner shall remain stayed . However, the enquiry against the petitioner shall be proceeded with and concluded expeditiously.
