Smt. Shabnam v. State of Haryana & Ors - CWP-9995-2002 RD-P&H 10154 (9 November 2006)
C.W.P. No. 9995 of 2006
Date of Decision: 13.11.2006
State of Haryana and others
CORAM: HON'BLE MR. JUSTICE M.M. KUMAR
HON'BLE MR. JUSTICE M.M.S. BEDI
PRESENT: Mr.Subhash Ahuja, Advocate,
for the petitioner.
Mr. Harish Rathee, Sr. DAG, Haryana,
for the respondents.
M.M. KUMAR, J. (Oral)
The original letter dated 28.12.2005 bearing Endorsement No. E-6-05/3004, has been produced by the learned counsel for the petitioner which in turn refers to another letter No.
1692, dated 21.12.2005, fixing the pay of the petitioner by giving her the benefit of her previous service. The original Dispatch Register concerning the office of the District Education Officer, Hisar, has C.W.P. No. 9995 of 2006
been produced before us and the entry with No. 2998-3068, dated 18.1.2006, does not appear to have any reference to the Endorsement No. E-6-05/3004, dated 28.12.2005. Similarly, in the dispatch dated 28.12.2005, the endorsement number in the Register are entirely different as the despatch commences from No. 2854 and goes upto
2906. There is no entry in the Dispatch Register showing Endorsement No. 3004 in the date of 28.12.2005. According to the preliminary objection raised by the respondents, the petitioner is alleged to have fraudulently procured the order issued under Endorsement No. E-6-05/3004, dated 28.12.2005, which is alleged to be a non-existent document. The matter is under consideration of the respondents and, therefore, at this stage we dispose of the petition with liberty to her to file again after the completion of departmental action.
The petition stands disposed of in the above terms.
