The petitioners have approached this Court for issuance of directions to the respondents to allocate/allot/provide chambers or land in the Judicial Complex, Ludhiana for carrying on their activities. The petitioners are Vasika Nawis, Stamp Vendors, Photostat Machine Operators, Naksha Nawis and Typists who were working in the old Judicial Complex, Ludhiana.
Shri Sukhdip Singh Brar, the learned Additional Advocate General, Punjab, on instructions from the departmental representative, has informed the Court that although the matter has been taken up by the Deputy Commissioner, Ludhiana with the State Government for providing some place to the persons, such as, the petitioners but because of the paucity of the space, it is not possible to find a suitable location for adjusting the petitioners.
Shri P.S.Khurana, the learned counsel appearing for the petitioners has relied upon a decision dated May 17, 2004 taken by the Building Committee of the High Court, whereby it had been decided that a fresh block would be constructed for Typists, Deed Writers, Photostat Machine Operators and Stamp Vendors at Judicial Court Complex, Ludhiana.
Shri Khurana has also maintained that sufficient land is available for adjustment of the claim of the petitioners.
Keeping in view the divergence stand taken by the learned counsel for the parties, we dispose of the present petition with a liberty to the petitioners to approach the Deputy Commissioner, Ludhiana with a site plan indicating the place where the petitioners can be so adjusted. The Deputy Commissioner, Ludhiana shall look into the feasibility of the aforesaid proposal submitted by the petitioners and thereafter, if some place is found to be suitable, take up the matter with the State Government for appropriate decision.
A copy of the order be given dasti on payment of usual charges.
