Petitioner Palwinder Singh alias Happy had submitted application for grant of bail before the Inspecting Judge of this Court during Jail Inspection, which has been treated as a petition under Section 439 of the Code of Criminal Procedure and has been put on judicial side. The petitioner is seeking regular bail in case FIR No. 25 of 2004 registered at Police Station Sadar Kapurthala under Sections 489-A, 489-B, 489-C, 420, 120 IPC and Section 18/61/85 of the NDPS Act.
With the assistance of the State Counsel, I have gone through the record of the case.
Learned State counsel submits that in this case, fake currency notes and 2 Kgs. of opium were recovered from the possession of three persons, including the petitioner, while they were going on motor cycle. He has further informed that the prosecution evidence in the case has been concluded and the case is now fixed for 16.1.2007 for defence evidence.
In view of the aforesaid facts, I am not inclined to grant regular bail to the petitioner.
