The petitioner, who is a life convict, is aggrieved at the order dated 29.7.2006 (Annexure P-1) passed by the Director General of Prisons, Haryana, whereby his request for temporary release on parole for house repair has been turned down on the ground that his house is in good condition and does not need any repairs.

Relying upon the report dated 10.8.2006 purported to have been made by the Gram Panchayat (Annexure P-2), learned counsel for the petitioner contends that the house of the petitioner is in bad condition and is in dire need of repairs.

Unfortunately, in their written statement, the respondents have not dealt with the genuineness or otherwise of the alleged report of the Gram Panchayat.

Consequently, this petition is disposed of with a direction to the Director General of Prisons, Haryana (in association with the District Magistrate, Panipat) to get the whole matter re-verified. If it is found that the alleged report of the Gram Panchayat dated 10.8.2006 is not a genuine document, a specific mention to this effect shall be made in the order rejecting the petitioner's request for parole. However, if it is found that the said resolution is genuine and the facts mentioned therein are also correct, then the petitioner's request to be released on parole for house repairs shall be objectively re-considered and decided within a period of two months from the date a certified copy of this order is received.

Disposed of.
