Radha Swami Bus Service (Regd.) v. State Transport Commissioner, Punjab and - CWP-6018-2006 [2006] RD-P&H 2165 (30 March 2006)

CWP NO. 6018 OF 2006 1

IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

CWP NO. 6018 OF 2006

DATE OF DECISION: 21.4.2006

Radha Swami Bus Service (Regd.) ....Petitioner.

Versus

State Transport Commissioner, Punjab and another ....Respondents.

CORAM: HON'BLE MR.JUSTICE J.S. KHEHAR
HON'BLE MR.JUSTICE P.S. PATWALIA

PRESENT: Mr.Ashu M. Punchhi, Advocate for the petitioner.

J.S. Khehar, J. (oral)

The petitioner is stated to have submitted an application for grant of a permit on the Jalandhar-Ambala Cantt via Ludhiana-Khanna- Rajpura route. He is also stated to have deposited the application fee prescribed therefor. It is, however, the contention of the learned counsel for the petitioner that no decision has been taken on the aforestated application submitted by the petitioner by the Regional Transport Authority, Jalandhar.

Learned counsel for the petitioner states that the petitioner will be satisfied if the instant writ petition is disposed of by directing respondent No.2 i.e. the Regional Transport Authority, Jalandhar, requiring it to take a final decision on the application.

Notice of motion.

On our asking, Mr. Ashok Aggarwal, Additional Advocate General, Punjab, accepts notice on behalf of respondents No.1 and 2.

CWP NO. 6018 OF 2006 2

Learned counsel for the respondents states that he has no objection to the disposal of the instant writ petition in terms of the prayer made by the learned counsel for the petitioner.

In view of the above, without going into the claim raised by the petitioner, we consider it just and appropriate to dispose of the instant writ petition by directing respondent No.2 i.e. the Regional Transport Authority, Jalandhar, to take a final decision on the application filed by the petitioner on 22.10.2005 (Annexure P1) by passing a well reasoned speaking order within two months from the date of receipt of a certified copy of this order.

Disposed of accordingly.

Order dasti on payment of usual charges.
