When the instant writ petition came up for hearing on 24.3.1999, the following orders was passed:- "Let the petitioner place on record any
circular/ notification revising the pay scale of the category of the petitioner after January 1, 1978, and prior to the issuance of the order dated August 12, 1985, copy annexure P-7.
Adjourned sine die. As and when the needful is done, the case be put up for motion hearing." Despite the aforesaid order, the petitioner has not placed on the record of this case the material referred to in the aforesaid order nor he has moved an application for listing the main case for further hearing. Learned counsel seeks further time so as to enable him to place the required material on the record of this case. On our having expressed our disinclination to the aforesaid prayer for any adjournment in this case, learned counsel for the petitioner states that he may be permitted to withdraw the instant writ petition with liberty to file a afresh one on the same cause of action after placing on the record of this case the required material depicted in the order extracted above.
We find the aforesaid request of the petitioner genuine. We, accordingly, accept the same. The instant writ petition is dismissed as withdrawn with liberty as prayed for.
