In pursuance to the order dated September 14, 2004 passed by this Court, the learned counsel for the petitioner informs the Court that violations in question have not yet been removed by the petitioner.
In view of the aforesaid fact, the leaned counsel appearing for the petitioner wishes to withdraw thepresent petition with a liberty to the eptitioner to file a fresh petition on the same cause of action by removing the violations and also stopping the misuser of the premises in question at the first instance before approaching this Court.
Dismissed as withdrawn with liberty, as aforesaid.
