Vide order dated 22.3.2001, ejectment of the petitioner was ordered by the competent authority. He went in appeal, which was dismissed vide order dated 24.9.2001. Both the Courts below have found it as a matter of fact that the Municipal Council is the owner of the disputed shop and ejectment of the petitioner has been ordered on the ground of sub- letting.
When this matter came up for hearing on 13.12.2001, following order was passed by this Court:-
"The counsel prays for an adjournment to enable him to place on record the evidence to show that the petitioner was, in fact, in occupation of the premises. He had not sublet the shop.
To be listed after the needful has been done." Thereafter, nothing has been done. It obviously means that the petitioner has no evidence to show that he was in occupation of the shop, in dispute. This writ petition has been fixed under special orders passed by Hon'ble the Acting Chief Justice, after notice to the counsel. None has put in appearance to assist this Court on behalf of the petitioner.
