The appeal was adjourned sine die on August 09, 2000. Earllier thereto also, a request for adjournment was made by the counsel on July 03,
2000. The appeal was put up on November 11, 2005. No one appeared on behalf of the appellant. Consequently, the appeal was ordered to be listed for motion hearing. No one appears on behalf of the appellant today as well.
I have gone through the record of the case .
Defendant no.3 Mangat Ram has approached this Court through the present appeal. Suit for permanent injunction filed by Pran Nath and Rajinder Nath was decreed by the trial court . An appeal filed by Mangat Ram failed before the first appellate court. Both the courts below have concurrently held that the plaintiffs are in possession of the suit property and consequently, the defendants were restrained from interfering in the R.S.A.No.1057 of 2000 : 2 :
possession of the plaintiffs except in due course of law.
Nothing has been shown that the findings recorded by the courts below suffer from any infirmity or are contrary to the record.
No question of law, much less any substantial question of law arises in the present appeal.
