Date of Decision: 31.8.2006

Union of India & others
CORAM: HON'BLE MR. JUSTICE M.M. KUMAR
HON'BLE MR. JUSTICE M.M.S. BEDI
PRESENT: Mr. Balram Singh, Advocate,
for the petitioners.
Mr. Puneet Jindal, Advocate,
for the respondents.
M.M. KUMAR, J. (Oral)
The respondents have raised a preliminary objection that regular remedy under Section 19 of the Administrative Tribunal Act, 1985 by filing Original Application before the Central Administrative Tribunal is available to the petitioners. Without exhausting the aforementioned remedy, the petitioners should not have approached this Court by invoking the provisions of Article 226 of the Constitution.
In view of the above, we dismiss the instant petition by relegating the petitioners to the remedy of filing Original Application before the appropriate bench of Central Administrative Tribunal.
