Sukhwinder Singh v. M/S Khushi Ram Jiwan Dass - CR-1058-2006 [2006] RD-P&H 779 (15 February 2006)

IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH.

CIVIL REVISION NO. 1058 of 2006

DATE OF DECISION: February 23, 2006.

Parties Name

Sukhwinder Singh

..PETITIONER

VERSUS

M/S Khushi Ram Jiwan Dass

...RESPONDENT

CORAM: HON'BLE MR. JUSTICE JASBIR SINGH
PRESENT: Mr. Vijay Rana,Advocate, for the petitioner.

JUDGMENT:

Vide order under challenge, defence of the petitioner was struck off for want of filing written-statement. Present revision petition has been filed after about 1- year of the passing of the said order. This clearly indicates that from the day one, intention of the petitioner was to delay the proceedings. No doubt, provisions of Order 8 Rule 1 CPC are directory in nature and not mandatory and written-statement can be taken on record beyond the period prescribed, but act of the petitioner is such that he is not entitled to any relief from this Court. Dismissed.
