Petitioner Gurdev Singh has filed this petition under Section 439 of the Code of Criminal Procedure for grant of regular bail in case FIR No. 94 dated 26.5.2000 under Sections 420/379/411 IPC, registered at Police Station Ghanaur, District Patiala.
2. I have heard counsel for the parties and gone through the contents of the FIR as well as the order dated 10.8.2006, passed by Sessions Judge, Patiala, whereby bail application of the petitioner has been dismissed.
3. In this case, the petitioner jumped bail on 17.2.2004. He was declared proclaimed offender on 30.11.2005 and was arrested on 15.6.2006.
Since then, he is in custody. Counsel for the petitioner contends that till date, not even a single prosecution witness has been examined and trial is not likely to conclude soon. Counsel states that in case bail is granted to the petitioner, he is ready to furnish heavy surety.
4. In view of the aforesaid facts, keeping in view the custody period, without expressing any opinion on the merits of the case, I deem it appropriate to grant bail to the petitioner. He is accordingly ordered to be released on bail subject to his furnishing bail bonds with heavy surety to the satisfaction of the trial court.
