In this writ petition, challenge has been laid to the order Annexure P-12, vide which Block Development & Panchayat Officer, has ordered recovery of Rs.1,45,045/-, from the petitioner, who is Ex-Sarpanch of the village. During arguments, it transpires that the above said order is appealable.
Faced with this situation, counsel for the petitioner very fairly states that let this writ petition be disposed of and liberty be granted to the petitioner to avail an alternative remedy, as per law.
To the prayer made, no objection has been raised by counsel for the respondents.
In view of facts mentioned above, this writ petition is disposed of, with liberty to the petitioner to file an appeal as per law. If any appeal is filed within four weeks from today, bar of limitation shall not be applicable against the petitioner. It is further made clear that interim order passed by this court on April 03,2006, shall continue to operate for a period of one month and thereafter, petitioner may move an application for interim relief, before appropriate authority, which shall pass an order as per law.
