This revision petition arises out of the order passed by the learned Courts below allowing the application moved by the respondents- plaintiffs under Order 39 Rule 1 & 2 C.P.C.
The learned Courts below on the basis of material placed on record have come to the conclusion that the plaintiffs-respondents were in possession of the property in dispute and, therefore, were entitled to protect their possession.
The learned counsel for the petitioner has challenged the order primarily on the plea that the petitioner was in fact in possession of the property. However, this contention of the petitioner cannot be accepted, in C.R.No. 5950 of 2006
view of the fact that the application moved by the petitioner for correctrion of the Khasra Girdawari stands dismissed.
