This is a petition for regular bail. Case is for offence under Section 18 of NDPS Act.
On behalf of the State, it is argued that there has been recovery of 1 kg of opium and 19 bags of poppy husk each containing 37 kgs. That petitioner is in the business of contraband articles and he had made extra judicial confession before one Jagtar Singh. It is also stated on behalf of the State that challan has been presented and case is now fixed for framing of charge.
Petitioner had earlier filed Crl.M.No.46062-M of 2006, which CRL.M.No.1080-M of 2007 #2#
was disposed of vide order dated 7.9.2006 with a direction to the trial Court to hold expeditious trial after framing of charge and recording of statement of Jagtar Singh at the earliest possible. At that time, petitioner was given liberty to file fresh application for bail, thereafter. Copy Annexure P-4 shows that the statement of Jagtar Singh had been recorded and he has not supported the prosecution case. Petitioner is stated to be in custody for the last nine months. Even Nachhatar Singh another witness has not supported the prosecution.
In view of the facts and circumstances of the case, it is directed that the petitioner shall be released on bail by the trial Court to its satisfaction.
