Dinesh Kumar ....Petitioner
Mr. Karan Singh, Advocate
State of Haryana & Ors. ...Respondents
Mr. Tarun Aggarwal, Sr.DAG, Haryana.
HON'BLE MR. JUSTICE SURYA KANT.
1. Whether Reporters of local papers may be allowed to see the judgment?
2. To be referred to the Reporters or not?
3. Whether the judgment should be reported in the Digest? SURYA KANT,J.(ORAL)
The petitioner has been denied parole for agricultural purposes on the ground that there is no agricultural land owned by him.
In order to counter the above noticed reason, the petitioner has placed reliance upon a copy of the order dated 24.6.2004 of the Assistant Collector 2nd Grade whereby mutation in respect of land measuring 4 marlas (114 sq. yards) was sanctioned jointly in favour of the petitioner and his brother Rajesh Kumar. .
Even if one relies upon the afore-stated mutation order, it comes out that the petitioner is owner in possession of land measuring 57 sq. yards only which, by no stretch of imagination, can be utilized to carry out agricultural operations.
Consequently, no fault can be found with the impugned order dated 15.6.2006 passed by the Director General of Prisons, Haryana.
