This appeal has been filed against judgment and decree dated December 14, 2005, vide which the Court below has granted decree of divorce in favour of the respondent. Both the parties are present in Court.
They have been identified by their respective counsel. A joint statement has been made stating that during pendency of this appeal, both the parties have settled their dispute and now the appellant is living happily in her matrimonial house. Counsel for the respondent, on getting instructions from the respondent, who is present in Court, states that he has no objection in case judgment and decree, passed in his favour, are ordered to be set aside and his application under Section 13 of the Hindu Marriage Act, 1955, is deemed to have been dismissed as withdrawn. To the fair concession shown, no opposition has been made by counsel for the appellant.
In view of facts, mentioned above, this appeal is allowed and the judgment and decree under challenge are set aside. Application filed by the respondent under Section 13 of the Hindu Marriage Act, 1955, shall be deemed to have been dismissed as withdrawn. Decree sheet be prepared accordingly.
