This is petition against order dated 28.11.2006 passed by Civil Judge(Jr.Divn.), Kharar whereby request of the defendant/petitioner Dilbag Singh etc for tendering copies of judgments in additional evidence was declined.
I have gone through the order.
From the facts and circumstances of the case, I find that the trial Court after closing the evidence of the defendant had adjourned the case for rebuttal evidence.
Counsel for the petitioners states that only certified copies of an earlier litigation per se admissible is to be tendered.
C.R.No.232 of 2007 #2#
I find that no prejudice will be caused if the petitioners are allowed to file certified copies of the judgments.
Petition is allowed. One opportunity is granted to the petitioners subject to payment of Rs.1000/- as costs.
