O R D E RPetitioner who is the 2nd accused in Crime No.341/2006 of Medical College Police Station, Kozhikode for offences punishable under Sec. 379 I.P.C. in respect of the theft of a generator, seeks anticipatory bail.
2. The learned Public Prosecutor opposed the application.
3. I see no reason to grant anticipatory bail to the petitioner who is also involved in another crime of the Nadakkave Police Station, Kozhikode involving another generator. There is no reason why the petitioner should not surrender before the concerned magistrate court and seek regular bail. Accordingly, if the petitioner surrenders before the magistrate court and files an application for regular bail within two weeks from today, the same shall be considered and disposed of preferably on the same day on which it is filed. With the above observation this application is dismissed.
