The petitioner is the sole accused, in crime No.345/2006 of Vadakkencherry Police Station, for the offence punishable under Section 304B IPC. It is alleged that because of the cruelty, perpetuated on the deceased, the wife of the petitioner, and also the persistent demand of more dowry, his wife committed suicide, by hanging on 11.7.2006, in the house of the accused, the petitioner. Therefore, the police registered the case against him and he was arrested on 15.7.2006. Hence this application, under Section 439 Cr.P.C.

2. Considering the submissions made by either side and the progress of the investigation, I grant bail and release the petitioner from jail, subject to the following conditions:-

(a). The petitioner shall execute a bond for Rs.25,000/-, with two solvent sureties, each for the like sum, to the satisfaction B.A.5230/2006 2 of the Judicial Magistrate of First Class, Alathur.

(b). The petitioner shall report before the Investigating Officer, once in a week on every Thursday, between 10.00 a.m and 11.00 a.m., for a period of three months, starting from 31.8.2006.

(c). The petitioner shall not leave the State of Kerala until the final trial and disposal of the Sessions case.

(d). The petitioner shall not interfere with the investigation or tamper with the evidence or attempt to influence the witnesses or threaten them, and he shall not cause any hindrance, to the smooth conduct of the trial of the Sessions Case. The application is allowed as above. J.M.JAMES
