The Hon'ble MR. Justice M.N.KRISHNAN
O R D E R
M.N.KRISHNAN, J.C.R.P.No. 980 OF 2001 C
Dated this the 18th June, 2007.
O R D E RThis revision is preferred by the legal heir of deceased Murugan who was the declarant in the ceiling case. It is submitted that this Court has directed the legal representative of the declarant and also all the occupants who are in possession of the land to file objections but the Land Board has not considered those objections. It is also submitted that there is a direction to consider the statement that would be filed by the legal representative of the deceased declarant. But that has not been considered. The learned Govt. Pleader submits that petitions filed by the other persons are pending before the Taluk Land Board and they are claiming right under Section 7E of the Amended Act. The entire matter requires fresh consideration on the point stated by this Court in the earlier order. Therefore the order under challenge is set aside and the case is remanded back to the Taluk Land Board, Palakkad for consideration. The Taluk Land Board shall hear the legal representative of the declarant, consider the statement and also the other applicants whose C.R.P. 980/01 2 petitions are pending before the same Board for consideration. C.R.P is disposed of accordingly. M.N.KRISHNAN Judge jj
