W.P.(C). NO. 22939 OF 2007

Dated this the 16th day of August, 2007

J U D G M E N T

Petitioner is presently working as Upper Primary School Assistant in one of the schools under the corporate management of respondent No.2. According to her she is entitled to get seniority in the cadre of High School Assistant in the seniority list of Mar Augustine's High School and all consequential benefits arising there from. She had submitted Ext.P11representation in this regard before the Director of Public Instruction. The only prayer in this writ petition is to issue a writ of mandamus or such other appropriate writ or direction to the Director to pass orders on Ext.P11 representation.

2. It is brought to my notice that the Director has in fact passed orders on her representation, as requested by the petitioner. A copy of the said order dated August 1, 2007 has been made available for my perusal. Learned counsel concedes that almost all reliefs that the petitioner had sought for have been granted to her except an error in the effective date from which she is entitled to get the benefit. It is pointed out by the learned counsel that the date shown in the order WPC NO.22939/07 Page numbers (July 15, 1991) is apparently wrong. Petitioner contends that the date ought to be July 15, 1990. Anyhow, the only request that is now being made on behalf of the petitioner is to direct the District Educational Officer, Aluva, to take a decision in the matter, expeditiously in the light of the directions issued by the Director in the order passed by him. Therefore the officer mentioned above is impleaded as additional respondent No.3. Therefore, the writ petition is disposed of with a direction to the additional respondent No.3 to pass consequential orders in terms of the order issued by the Director of Public Instruction in Order No.ET4/20291/07/DPI D.Dis. dated 1.8.07. This shall be done as expeditiously as possible, at any rate, within one month from the date of receipt of a copy of this judgment after affording sufficient opportunity of hearing to the petitioner. Petitioner shall produce certified copy of the judgment along with a copy of the writ petition before additional respondent No.3 for compliance.
