JUDGMENT

The grievance of the petitioner is that though Ext.P1 conditional order under Section 133 Cr.P.C was pased as early as on 13.02.2006 and the petitioner was directed to appear before the Sub Divisional Magistrate on 31.03.2006, no further steps whatsoever have been taken by the Sub Divisional Magistrate. The learned Government Pleader on instructions submits that the matter now stands posted to 23.02.2007 and the needful shall be done to dispose of the proceedings-M.C.NO.53 OF 2006, as expeditiously as possible.

2. I find the grievance of the petitioner to be absolutely justified. It is not explained why no steps have been taken after 31.03.2006 for such a long period of time. I am, in these circumstances, satisfied that this Writ Petition can be allowed and a direction can be issued to the learned Sub Divisional Magistrate to dispose of M.C.No.53 of 2006 as expeditiously as possible - at any rate, prior to 15.05.2007. Compliance shall be reported to this Court.

3. This Writ Petition is, in these circumstances, allowed with the above observation. Hand over a copy of this order to the learned counsel for the petitioner for production before the learned Sub Divisional Magistrate.
