O R D E RThe petitioner, who is the first accused in Crime No.98/2006 of Thekkumbagam Police Station for an offence punishable under Section 302 IPC, seeks anticipatory bail.
2. The learned Public Prosecutor opposed the application submitting inter alia that one Sunil Antony, his wife and two children committed suicide on 6.3.2006 on being unable to withstand the demands by 41 persons from whom the petitioner collected more than 12 lakhs of Rupees offering employment and the said Sunil Antony was acting as a mediator.
3. Anticipatory bail cannot be granted in a case of this nature. There is no reason why the petitioner should not surrender before the Investigating Officer for interrogation and seek regular bail from the concerned Magistrate. Accordingly the petitioner is directed to surrender before the Investigating Officer either on 12.4.2007 or 13.4.2007 for the purpose of interrogation. The petitioner shall, thereafter, be produced on the same day before the Magistrate having jurisdiction, who shall consider and dispose of the application if any filed by the B.A.1939/2007 2 petitioner for regular bail. Such disposal shall preferably be on the same day on which it is filed. The application is disposed of as above. V.RAMKUMAR,
