O R D E RThis is a petition for special leave to appeal against the order in C.M.P. No.3627 of 2006 on the file of the Additional Chief Judicial Magistrate's Court, Thiruvananthapuram.
2. The impugned order is one passed under Section 204(4) Cr.P.C. Hence, an appeal will not lie. The petitioner is, therefore, permitted to withdraw the Crl. Leave Petition. The Crl. Leave Petition is accordingly dismissed as withdrawn without prejudice to the right of the petitioner to seek appropriate remedy as per law. Certified copy of the impugned order shall be returned to the counsel for the petitioner.
