W.P.(C) NO.15451 of 2007-M

Dated this the 23rd day of May, 2007

JUDGMENT

The petitioner challenges Ext.P1 order by which he has been transferred from Kollam to Idukki District. He submits, he has got only 7 months' service left. Other personal inconveniences arising out of transfer are also pointed out. But, I find Ext.P1 has been issued in public interest. Seventeen persons presently working in Idukki are transferred out and 17 persons from several Districts have been transferred to Idukki in public interest. This Court can interfere with a transfer order if only it is shown to be illegal or vitiated by malafides. Violation of transfer norms cannot be a ground for interfering with the transfer order. Therefore, the challenge against Ext.P1 is repelled as no ground has been made out to interfere with the same under Article 226 of the Constitution of India. The petitioner has filed Ext.P2 representation through proper channel as evident from Ext.P3. Therefore, the first respondent will consider and pass orders on it within one month from the date of receipt of a copy of this judgment. The Writ Petition is disposed of as above. K.BALAKRISHNAN NAIR,

JUDGE.
