Petitioner, who is the 16th accused in Crime No.179/07 of Chavara Police Station for offences punishable under Sections 143, 147, 148, 120(b), 427, 452 and 307 read with Sec. 149 I.P.C., seeks his enlargement on bail.

2. This application was opposed on behalf of the prosecution.

3. Having regard to the fact that the occurrence was the result of clashes between N.D.F. workers and R.S.S. workers and there are other connected incidents causing communal disharmony which have been spreading like wildfire, eventhough I am inclined to grant bail to the petitioner, it can only be with effect from a future date and that too on stringent conditions. Accordingly, the petitioner is directed to be released on bail with effect from 15.6.2007 on the petitioner executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like amount to the satisfaction of J.F.C.M., Karunagappally and subject to the following conditions:-

1. Petitioner shall not enter the limits of Kollam District until further orders to be passed by the Magistrate or by the Court to which the case is eventually committed. BA.3071/07

2. The petitioner shall report before the City Police Commissioner, Thiruvananthapuram between 9 a.m. and 11 a.m. on all Wednesdays.

3. The petitioner shall make himself available for interrogation as and when required by the police till the filing of the final report.

4. The petitioner shall not influence or intimidate the prosecution witnesses nor shall he attempt to tamper with the evidence for the prosecution.

5. The petitioner shall not commit any offence while on bail. If the petitioner commits breach of any of the above conditions, the bail granted to him shall be liable to be cancelled. This application is allowed as above.
