Heard learned counsel for the petitioner.
The controversy involved in the present case, in substance, is a dispute between one society and the other society, as such, the petitioners have an alternative remedy of going into arbitration in accordance with the provisions of the Rajasthan Cooperative Societies
So far individual grievance of the petitioner is concerned, the respondents have clearly submitted in para 10 at page 8 that "it is humbly submitted that presently both the Petitioners Primary Milk
Cooperative Societies situated at Village Baniyala & Dheerwas Beda are providing the Milk to M/s Churu Zila Dugdh Utpadak Sahakari Sangh
Limited, Churu, inspite of the said Order dated 3/7/2004 (Annexure 9) and the answering Respondents are having no objection in this respect.
The other Primary Milk Cooperative Societies of the Taranagar Tehsil are providing or supplying the Milk to M/s Ganganagar Zila Dugdh
Utapdak Sangh Ltd., Hanumangarh-Junction, for which the Petitioner cannot plead the causes of other Primary Milk Cooperative Societies & to file the Writ Petition in this respect". In view of this, it cannot be said that individually, the petitioner has any surviving grievance.
In view of all the above, I am not inclined to entertain the present writ petition. The same is, therefore, dismissed summarily.
