Three writ petitions being SB Civil Writ Petition
NO.5607/2004, 5609/2004 and 5610/2004 were disposed of by this Court on 12.4.2005 by following the order passed by the Division Bench of this Court at Jaipur in DB Special
Appeal (Writ) No.670/2004 dated 11.12.2004. The relevant part of purpose of deciding this appeal in the order dated 11.12.2004 is as under :-
"With the aforesaid directions, the appeal stands disposed of. Either of the party to the litigation is free to apply for revival of the appeal in case of its non- satisfaction with the decision of the
Committee on the representation of the appellant Corporation, by filing a simple note."
The petitioner Corporation has submitted these applications for revival of the aforesaid writ petitions in the circumstances mentioned in the applications.
According to learned senior counsel for the applicant, in the identical facts and circumstances, in view of the
Division Bench order dated 11.12.2004, DB Special Appeal
No.670/2004 has also been restored on moving application and identical writ petitions, which were disposed of following the decision of Division Bench dated 11.12.2004, also have been restored to their original number on the petitioner moving application for restoration.
In view of the above and in view of the order dated 11.12.2004 passed by the Division Bench and followed by this Court while deciding the aforesaid writ petitions by order dated 12.4.2005, the applications are allowed and the writ petitions no.5607/2004, 5609/2004 and 5610/2004 are restored to their original number.
The office is directed to list these writ petitions before appropriate bench for admission on 16.1.2005 as prayed by learned counsel for the applicant and agreed to by learned counsel for the respondents.
