Heard learned counsel for the appellant, and perused the application under Section 5 of the Limitation Act.

The only ground given is that the appellant was given to understand that the limitation is 90 days, and no details have been given as to who gave him to understand. The provisions under Section 32

(9) are very specific. Thus, the application does not disclose any sufficient ground whereby the appellant may have been prevented from filing the appeal within time. The application under Section 5 of the

Limitation Act is, therefore, dismissed, and in turn, the appeal is also dismissed as time barred.
