By the order Annexure-10, the State of Rajasthan cancelled the allotment of 5 bighas of land made in favour of Gram Panchayat,
Banad. A part of the land was allotted to the petitioner by the Gram
Panchayat, Banad vide Patta Annexure-9. The petitioner in present writ petition has challenged the validity of the order Annexure-10.
After filing the writ petition, the Collector, Jodhpur while exercising powers under Rule 272 of the Rajasthan Panchayat (General)
Rules, 1961 has cancelled and set aside the Patta Annexure-9 itself.
The order whereby the Collector, Jodhpur exercising powers under Rule 272 of the Rules of 1961 set aside the Patta Annexure-9, copy of which is supplied by the counsel for respondents be taken on record.
In view of it, the writ petition has become infructuous.
Accordingly, the same is dismissed as having become infructuous. [Govind Mathur],J.
