By an application being S.B.Criminal Misc. Application

No.263/2006, the petitioner seeks to substitute FIR No.23/2006 in place of FIR No.479/05 and name of police station Takhatgarh in place of the police station Balotra.

For the reasons mentioned in the application, the application seeking substitution of FIR No.23/06 in place of FIR

No.479/05 and name of police station Takhatgarh in place of police station Balotra is allowed. Amended cause title has already been filed, same may be place at appropriate place in the file.

Heard learned counsel for the petitioner and the Public

Prosecutor for the State on the second bail application.

The first bail application came to be dismissed by this Court on 04.04.2006 as it was not pressed by the counsel appearing for the petitioner. However, a liberty was granted to the petitioner to file a fresh bail application after the challan is filed. Learned counsel for the petitioner submits that now the challan has been filed. I have perused the challan papers.

Looking to the facts and circumstances of the case and having considered the oral arguments advanced by the counsel for the parties, I think it just and proper to enlarge the accused petitioner on bail.

Accordingly, this second bail application filed under Sec. 439

Cr.P.C. is allowed and it is directed that petitioner Taga Ram S/o

Raghunathji be released on bail in FIR No. 23/2006 P.S. Takhatgarh provided he executes a personal bond for a sum of Rs.20,000/- with two sound and solvent sureties in the sum of Rs.10,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
