NATIONAL INSURANCE COMPANY LTD v MAHADEV GURJAR - CMA Case No. 901 of 1999 RD-RJ 1325 (29 May 2006)
S.B. Civil Misc. Appeal No.901/99
National Insurance Company Ltd.
Mahadev Gurjar & Ors.
Date of Order : 29/05/2006
Hon'ble Mr. Justice Ajay Rastogi
Mr. Vizzy Agrawal, for appellant
Instant appeal has been filed against the award passed by the Tribunal dt.16th March, 1999 whereby a sum of Rs.1,25,000/- has been awarded to the claimant [insured] for the nature of injury sustained by him in the alleged accident which took place on 23rd May, 1997.
Counsel submits that looking to the nature of injury awarded amount is on higher side, requires interference by this court.
I have gone through the award passed by the
Tribunal. The claimant was 60 yrs. of age and looking to the nature of injury which he sustained in the alleged accident, I do not find any error committed by the
Tribunal in computing the amount payable to him under the impugned award.
Consequently, the appeal fails and is hereby dismissed. [Ajay Rastogi],J.
