This matter came up for orders on an application preferred by respondent workman under

Section 17-B of the Industrial Disputes Act, 1947

(hereinafter referred to as "the Act of 1947"). The respondent workman in the application has specifically stated that he is not in employment of any establishment since the date of his termination. The application is supported by an affidavit. Nothing is placed on record by the employer in rebuttal of the averment made by the workman.

The application under Section 17-B of the Act of 1947, therefore, is allowed. The petitioners are directed to adhere the provisions of Section 17-B of the Act of 1947 from the date of award impugned dated 31.3.2003.
