CHHAJJU AND ANR v STATE - CRLMB Case No. 829 of 2006 [2006] RD-RJ 2950 (28 November 2006)

S.B. Cr. Misc.IIIrd Bail (SOS) Application No.829/06.

S.B. Criminal Appeal No.1252/2004.

Manu @ Aashish Vs. State

Date of Order ::: 28/11/2006

Hon'ble Mr. Narendra Kumar Jain, J.

Mr. R.P. Vijay, Counsel for accused-appellant.

Ms. Nirmala Sharma, Public Prosecutor for State

Heard learned counsel for the accused- appellant as well as the learned public prosecutor for the State.

This is third application for suspension of sentence of the accused-appellant. The first bail application of the accused-appellant was dismissed by a detailed order on merits. Therefore, I do not think it fit and proper to allow this bail application and the same is accordingly dismissed.

However, in view of the fact that the accused- appellant has already remained in jail for about two- years-&-eight-months, I direct the Registry to list the appeal itself for hearing on priority basis. In case, the appeal is not heard finally within a period of six months, then it will be open for the appellant to move another bail application.

(Narendra Kumar Jain) J.
