Heard learned counsel for the accused- appellant as well as the learned public prosecutor for the State.
This is third application for suspension of sentence of the accused-appellant. The first bail application of the accused-appellant was dismissed by a detailed order on merits. Therefore, I do not think it fit and proper to allow this bail application and the same is accordingly dismissed.
However, in view of the fact that the accused- appellant has already remained in jail for about two- years-&-eight-months, I direct the Registry to list the appeal itself for hearing on priority basis. In case, the appeal is not heard finally within a period of six months, then it will be open for the appellant to move another bail application.
