This is a writ petition in which the University of Rajasthan has come up against the order dated 10.5.2006 by which the learned Additional District
Judge No.2, Alwar while reversing the order dated 24.3.06 passed by Civil Judge
(Jr. Division) No.1, Alwar issued an injunction order against the petitioners directing them that the respondent be permitted to appear in the LLB II Year
Examination and thereafter declare his result.
Learned counsel for the petitioners submits that the respondent accordingly appeared in the LLB I Year examination.
When his result was declared, he could clear only six out of nine papers and therefore in the facts of the case, he can now be permitted to appear in remaining three due papers as per the rules. He submits that if the respondent applies for appearing in those remaining three due papers, the university shall consider the same as per the rules and permit him to appear in those examinations as per the rules.
In the light of the statement made by learned counsel for the petitioners, I do not deem it necessary to examine the correctness of the impugned order dated 10.5.2006 on merits.
The respondent would be free to apply to the petitioners for appearing in the due papers as per the rules.
With these observations, the writ petition is disposed of.
