Counsel appearing for the petitioner states that the controversy involved in this writ petition is fully covered by the judgment rendered by this Court in
S.B. Civil Writ Petition No. 1577/2001- Punjab Sabha,
Kota Vs. State & Ors., dated 10.12.2001.
Having gone through the ratio decided by this
Court in the aforementioned case and the reliefs claimed by the petitioner, I am fully satisfied the the controversy involved in this case is squarely covered by the judgment dated 10.12.2001 rendered by this Court in the aforementioned case of Punjab Sabha, Kota
Hence, in the light of the judgment dated 10.12.2001, the present writ petition stands allowed and the notification impugned dated 31.03.98 is quashed and set aside to the extent only it relates to the petitioner's property. The respondents are free to make fresh decision in the matter after giving notice and opportunity of being heard to the petitioner. The judgment dated 10.12.2001 shall be treated as a part of this order.
