Instant petition is directed against the order of learned trial Judge dated 24th September, 1993 whereby application filed by respondent u/s.125 Cr.P.C. was allowed and awarded a sum of
Rs.500/- to herself and Rs.200/- for her son 17th
Mohd. Anees which was payable w.e.f.
It was her case before the learned trial
Judge that after their marriage was solemnized, she remained at her matrimonial home for about 2 years & 6 months and from this wedlock Mohd.
Anees was born and she was thrown out from her matrimonial home in August, 1991. There is no other means for her livelihood. Taking note of the income of her husband i.e. present petitioner, learned Court considered appropriate to award Rs.500/- to the wife and Rs.200/- to her son payable from 17th September, 1992.
This court does not find any error committed by learned Judge under order impugned which may call for any interference.
Consequently, the misc. petition fails and is hereby dismissed. Record be sent back to court below forthwith. [AJAY RASTOGI],J.
